Exceptional disclosure 

Exceptional disclosure is a process where non-convictions of criminal charges that did not result in a conviction in court may be released. It is possible that information in the applicant's record meets the Exceptional Disclosure Assessment and can be released under the authority of the Police Record Checks Reform Act, 2015 (PRCRA Regulation 350/18).

Reconsideration process

An applicant who has obtained a Vulnerable Sector Check may apply to have their record check reconsidered and have information excluded from the results. This process is not suitable for the Criminal Record Check or Criminal Record and Judicial Matters Check because the process is for the purposes of non-convictions only. Individuals wishing to have information removed from a Criminal Record Check or Criminal Record and Judicial Matters Check can utilize the Parole Board of Canada's record suspension process.

York Regional Police takes the following criteria into account when assessing a request for reconsideration:

  • Date of the incident 
  • The age of the applicant at the time of the incident 
  • All information available relating to the applicant, including Crown notes 
  • Details of the incident, including any written information provided by the applicant or others who had contact with the individual at the time of the incident, if available

A request for reconsideration must be received by York Regional Police, in writing, within 45 days of the completion of the applicant's record check, unless, through no fault of their own, the applicant was unable to submit the request within that time.
